Athelos Terms of Service

1. These terms

Athelos is operated by Dogwood Ventures LLC, Horace, North Dakota (“we”, “us”).

By creating an account or using Athelos you agree to these terms. If you don’t agree, don’t use the service.

Our Privacy Policy explains how we handle your information and forms part of these terms.

2. Who can use Athelos

You must be 18 or older to hold an account, with one exception: an athlete aged 13 or older may hold their own account with their guardian’s involvement.

Children under 13 do not get accounts.A parent or legal guardian creates and controls a younger athlete’s record.

If you create a record for a child, you confirm you are their parent or legal guardian and that you have the authority to provide their information and to make decisions about it.

We may suspend or close an account that does these things.Where a child’s safety is involved we may act immediately and without notice.

5. Your content stays yours

You own what you put into Athelos— your photos, videos, notes, goals, and the record you build. Creating an account doesn’t transfer ownership of anything to us.

You give us permission to store, display, process and back up your content only so we can operate Athelos for you— for example, to show a photo in your gallery, include it in a yearbook you order, or send it to our print partner to make a book you bought. That permission ends when you delete the content or close your account, except where we’re legally required to keep records (see section 9).

We do not sell your content. We do not use it to advertise. We do not use it to train advertising profiles.

If you believe content on Athelos infringes your rights, email support@athelos.net with the details and we’ll review and act on it promptly.

6. How Athelos shares information between people

This is a core part of the product, so we’re specific about it. The full detail is in the Privacy Policy; the short version:

Content your gym creates about your athlete belongs to the gym.Where it’s shared with you, you can see it but not edit or delete it — if you disagree with something, you can record your own version alongside it.

If you create a share link, anyone who has that link can see what the link includes for as long as it’s active. You choose who to give it to, and you can revoke it at any time. Please share links only with people you trust to see your athlete’s information.

Prices may exclude applicable sales tax, which is shown at checkout where we’re required to collect it.

8. Gyms

A gym account is held by the gym, not by an individual coach. Whoever creates it confirms they’re authorized to bind that business.

Gyms are responsible for the accuracy of what they record about athletes, and for how their own staff use the service. A gym may not use a family’s information for anything other than coaching that athlete — no marketing to other families, no resale, no transfer to another business.

If a gym’s subscription ends, its staff lose access. Families keep their own records regardless— a family’s content is never contingent on their gym’s payment.

9. Keeping, exporting and deleting your record

You can export your athlete’s record at any time, free, in a format you can keep.

You can delete your account at any time. What happens then:

We will always offer you an export before a deletion is finalized. Please take it.

Deletion timeframes and what we keep for tax purposes are set out in the Privacy Policy.

10. If Athelos ends

We think you should know this before you trust us with years of your family’s memories.

If we ever discontinue Athelos, we will:

We can’t promise a service will exist forever. We can promise you won’t lose the record without warning and without a way to take it with you.

11. Availability and changes

We work to keep Athelos available but we don’t guarantee uninterrupted service. We may add, change or remove features.

We may perform maintenance that makes the service briefly unavailable.

12. Suspension and termination

You may close your account at any time (section 9).

We may suspend or close an account that breaches these terms, that we’re legally required to act on, or where we reasonably believe a child is at risk. Except where a child’s safety or the law requires immediate action, we’ll tell you why and give you a chance to respond.

13. Disclaimers

Athelos is provided “as is”. We don’t warrant that it will be error-free or that it will meet every need.

Athelos is a record-keeping, communication, coaching-assist and memory-keepsake service.Skill records reflect what people entered; they aren’t a certification that an athlete can safely perform a skill. Decisions about what an athlete attempts are for their coaches and guardians, not for Athelos.

14. Limits on liability

We’re not liable for indirect or consequential losses, or for loss of content where you had the ability to export it and didn’t.

Nothing here limits liability that can’t be limited by law.

15. Disputes and governing law

These terms are governed by the laws of the State of North Dakota, without regard to conflict-of-laws rules.

16. Changes to these terms

If we make a material change, we’ll tell you by email and in the app before it takes effect. Continuing to use Athelos after that means you accept the new terms. If you don’t accept them, you can close your account and export your record.
